    Divorce Appraisals

Impartial, court-defensible property valuations to ensure a fair and equitable division of assets during a divorce.

    Understanding Divorce Appraisals

A divorce appraisal is an independent, professional opinion of a residential property's market value, prepared to help spouses, attorneys, and the court understand what a home is worth during the division of marital property. At NC Real Estate Appraisals, we prepare these valuations for homeowners, attorneys, and mediators who need a supported value to inform decisions about a shared residence.

The report is a supported opinion of value, not a determination of how property must be divided or a guarantee of any particular outcome. How the value is used in a settlement is decided by the spouses, their attorneys, and the court. We encourage you to confirm the legal requirements that apply to your case, including the appropriate valuation date, with your attorney before commissioning the appraisal.

How an Appraisal Supports Property Decisions

When a shared home is part of a divorce, the spouses may sell the property and divide the proceeds, or one spouse may buy out the other's interest. An appraisal provides a common, documented reference point for those conversations. It describes the property's market value as of a defined date. It does not by itself set the buyout amount, which may also reflect the mortgage balance, closing costs, taxes, and other factors your attorney can help you weigh. Appraised value is not the same as equity or the final buyout figure.

Independent Valuation and the Appraiser's Role

As certified appraisers, we are bound by the Uniform Standards of Professional Appraisal Practice (USPAP), which requires us to remain independent and objective. We are not advocates for either spouse; we develop a supported opinion of value based on the property's characteristics and relevant market evidence. The appraisal is prepared for the intended use and intended users identified during engagement, and report distribution depends on the terms of that engagement and any applicable obligations.

An appraisal differs from a real estate agent's comparative market analysis, a tax assessment, or an online estimate in purpose, scope, and methodology. A CMA is a marketing tool that suggests a listing price; a tax assessment reflects assessed value for jurisdictional purposes; and an online estimate is an automated calculation. An appraisal is a professionally developed, supported opinion of market value prepared under USPAP for a defined intended use. Each can be useful for its own purpose, and which is appropriate depends on what the value will be used for and what the recipient requires.

    Choosing the Effective Valuation Date

The effective date of the appraisal is the date as of which the value is estimated. In a divorce, more than one date may be appropriate depending on the circumstances and the guidance of your attorney. Common options include the current date, the date of separation, or another agreed retrospective date. There is no single date that applies to every case.

Confirm the appropriate date with your counsel and share it with us when you request the appraisal, since it shapes the market data we research and analyze. A retrospective date can require additional research into historical sales and market conditions that existed at that time.

    Documents and Information to Gather

You do not need to assemble everything before reaching out, but the following can help us prepare an accurate quote and report:

    • The property address and a brief description of the home.
    • The intended use of the report and who the intended users are.
    • The valuation date your attorney has advised, if one has been set.
    • Information about recent renovations, additions, or deferred maintenance.
    • Any available photographs, prior appraisals, surveys, or HOA documents.
    • The name and contact information for the attorney or mediator coordinating the matter.

The specific items needed depend on the assignment. We can guide you through what is required once we understand the property and the intended use. Please do not upload sensitive legal filings or financial account records through the website form; share those details directly with us as needed.

    How the Appraisal Process Works

While each assignment is tailored to its purpose, a typical divorce appraisal follows these steps:

    1. Scope and engagement. We confirm the intended use, intended users, effective date, and scope of work before beginning.
    2. Inspection. We inspect and document the property's condition and features, or agree on an alternative scope when an interior inspection is not possible.
    3. Market research. We analyze recent comparable sales and market data relevant to the effective date, adjusting for differences between the subject and the comparables.
    4. Reconciliation and reporting. We develop a supported opinion of value and prepare a written report documenting the analysis and conclusions.
    5. Delivery. The completed report is delivered to the intended user according to the engagement.

Questions About Access, Separate Appraisals, and Report Use

Property access is arranged as part of the engagement. When both spouses can agree on a single, jointly engaged appraiser, that can reduce cost and provide one shared reference point, but a joint engagement is not required or appropriate in every case. If each spouse obtains a separate appraisal, the reports may differ because of different effective dates, assumptions, scope, property information, or comparable sales selected. Differing values are not automatically resolved by averaging; if the reports need to be reconciled, that is generally handled by the parties and their attorneys, and sometimes by the court.

Who may use the report and how it may be shared depend on the engagement and applicable obligations. The person who engages the appraiser or pays the fee does not automatically control the conclusion or determine who receives the report. We can discuss the appropriate engagement structure with you and your attorney.

    Factors Affecting Cost and Turnaround

The fee and completion timeline depend on the specifics of the assignment, including the property type and complexity, the effective date, the scope of work, and whether an interior inspection is performed. A retrospective valuation can require additional research into historical market data. Rather than quote a fixed fee or timeline here, we review the details of your property and assignment and provide a customized estimate.
